Conditions Relating to Your Use of the BCS Online Bookshop

All products sold on this site are published by its subsidiary BCS Learning and Development Ltd. When purchasing from this site your contract will be with BCS Learning and Development Ltd.

1. Use of the Online Bookshop

Due to the nature of the Internet we cannot guarantee that the website will be uninterrupted or error free or that downloadable content is virus free.

You should maintain the confidentiality of your account and password and restrict access to your computer to prevent unauthorised access of your account.

In using this website, you agree that the website is for your personal, non-commercial use only. You may not copy, make available to the public, download, store (in any medium), show in public, adapt or change in any way the material (or any part of it) contained on this website for any purpose whatsoever.

You must not use this website to:

• commit or encourage unlawful acts or in breach of these terms of use
• misrepresent your identity

2. Your order

When you place an order to purchase a product from BCS Learning and Development Ltd. this represents an offer by you to purchase a product which is only accepted by us when we send you notification of delivery or when we dispatch the item to you.

If you wish to order services additional to your initial orders then these need to be ordered online as a separate order. No changes will be possible to the initial order once it has been submitted.

If the title you have ordered is not yet published at the time of your order, we will record a backorder for you and arrange for it to be sent on when it has been received at our warehouse. You will not be charged for these items until they are despatched.

3. Returns

If, for any reason, you are not completely satisfied with your purchase you may return the goods with a covering letter within 30 days. We will replace the goods or give a full refund.

In addition to your 30-day returns guarantee, customers in the UK are entitled to a statutory cooling-off period of fourteen days. Details of this statutory right and an explanation of how to exercise it are provided in the order confirmation e-mail.

4. Pricing and availability


We list availability information for products sold by us on the website, including on each product information page. Beyond what we say on that page or otherwise on the website, we cannot be more specific about availability. Please note that dispatch estimates are just that. They are not guaranteed dispatch times and should not be relied upon as such. As we process your order, we will inform you by e-mail if any products you order turn out to be unavailable.

Despite our efforts, a small number of the products in our catalogue may be mispriced. Rest assured, however, that we verify prices as part of our dispatch procedures. If a product's correct price is lower than our stated price, we charge the lower amount and send you the product. If a product's correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before dispatch or cancel your order and notify you of such cancellation.

All prices are inclusive of VAT unless stated otherwise.

When ordering goods from BCS Learning and Development Ltd. for delivery overseas you may be subject to import duties and taxes, which are levied once the package reaches the specified destination.

5. Losses


BCS Learning and Development Ltd. will be responsible for any losses you suffer as a result of us breaching these conditions if the losses were reasonably foreseeable to both you and us when you commenced using the website, or a contract for the sale of goods by us to you was formed. We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when you commenced using the website or when a contract for the sale of goods by us to you was formed. BCS Learning and Development Ltd. does not limit in any way our liability by law for death or personal injury caused from our negligence or breach of duty or caused by our gross negligence or wilful misconduct.

6. Alteration of Service or Amendments to the Conditions


We reserve the right to make changes to our website, policies, and these Conditions of Use & Sale at any time. You will be subject to the policies and Conditions of Conditions of Use & Sale in force at the time that you use the website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

7. Events beyond our reasonable control


We cannot be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.

All content and software included on the website is the property of BCS, its affiliates or its content suppliers. United Kingdom and international copyright and database right laws. All software used on this website is the property of BCS, our affiliates or our software suppliers.

You may not systematically extract and/or re-utilise parts of the contents of the website without BCS's express written consent. In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation of any substantial parts of this website, without BCS's express written consent.

10. Miscellaneous


10.1 These terms and conditions of use are not intended to, nor shall they confer any benefit on a third party, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.

10.2 No waiver by BCS Learning and Development Ltd. of any breach of these terms by you shall be considered as a waiver of any subsequent breach of the same or of any other provision.

10.3 If, at any time, any provision of these terms is or becomes invalid or illegal in any respect, such provision shall be deemed to be severed from the terms, but the validity and enforceability of the remaining provisions shall not be affected as a result.

11. Governing Law and Jurisdiction


These terms and conditions are governed by and construed in accordance with the laws of England and Wales and the application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. You agree, as we do, to submit to the non-exclusive jurisdiction of the English courts.
